By visiting bloomfolio.com or placing an order, you agree to these terms. If you do not agree, please do not use the site or request services. We aim for clarity in pricing, scheduling, and delivery logistics while maintaining reliable communication through the ordering lifecycle. If you represent a business and enter a contract with BloomFolio, these terms apply unless a separate signed agreement exists that states otherwise. Using Our Services
When you place an order through our site, by email, or during a consultation, you agree to provide accurate information and to follow any provided guidance relating to delivery and care. Orders accepted by BloomFolio form a binding agreement once we issue an order confirmation. Confirmations will include key details such as selected stems, delivery date and window, billing, and any agreed set-up or breakdown services. For bespoke projects we may request deposits to secure dates and initiate sourcing. Deposits are applied to the final invoice and may be non-refundable where stems or labor are confirmed and purchased on your behalf. If a requested date or product is unavailable we will notify you promptly and offer reasonable alternatives or a full refund. For subscription services you authorize periodic charges for the plan selected until you cancel according to the subscription terms. You are responsible for communicating venue requirements, access windows, and any relevant constraints that could affect delivery or installation. We reserve the right to refuse service for unlawful requests or misuse of the site.
Pricing, Payment, and Delivery
Prices listed on the site reflect current offers and seasonal availability and are shown in US Dollars where applicable. Final prices for bespoke projects may vary due to stagings, special stems, or logistical requirements. Payment may be collected via the payment methods displayed at checkout. We use trusted third-party payment processors; BloomFolio does not store full payment credentials on our systems. For event work the estimated total will account for stems, labor, containers, transport, and any on-site set-up or breakdown time. Delivery times are estimates and may be influenced by traffic, weather, or venue access. For same-day or expedited deliveries an additional fee may apply. If a delivery attempt fails due to incorrect address, recipient unavailability, or venue restrictions, additional delivery attempts may incur charges. Risk transfers to the recipient upon delivery. Please notify us immediately if a delivery arrives damaged, and provide photos and brief details so we may assess and determine appropriate remedies in line with these terms.
Intellectual Property and Content
All site content including text, images, layout, and design remains the property of BloomFolio or our licensors and is protected by copyright, trademark, and other laws. You may view and print materials for personal use but must not reproduce, distribute, or create derivative works without our written permission. When clients provide photos or content to BloomFolio for publication, we will request permission to use such content in our portfolio or marketing. If you provide creative materials as part of an order, ownership of those materials remains with you; BloomFolio retains the right to display completed works in our promotional materials unless an alternative written agreement states otherwise. For commissioned content involving custom design concepts, BloomFolio and the client will agree in writing how rights and licenses are managed, especially for large-scale installations or branded work where usage and attribution matter for both parties.
Limitation of Liability and Indemnification
To the fullest extent permitted by law, BloomFolio is not liable for indirect, incidental, special, punitive, or consequential damages arising from use of our services, including but not limited to loss of revenue, loss of opportunity, or loss of goodwill. Our liability for direct damages is limited to the amount paid by you for the specific order giving rise to a claim. You agree to indemnify and hold BloomFolio, its employees, agents, and vendors harmless from third-party claims arising from your breach of these terms or your misuse of services. This allocation of risk reflects the nature of our product and the pricing of services. Nothing in these terms is intended to limit rights that cannot be excluded under applicable law.
Changes to Terms and Contact
